Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the VibeWin website and service (the “Service”), operated by Leandro Leonel Utz Torrisi (“we”, “us”). Our full identification details are in the Legal Notice. By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. What VibeWin is (and is not)

VibeWin is a discovery and research tool: we find publicly announced giveaways, sweepstakes, and contests run by third parties (“Giveaways”), analyze them, and present summaries, scores, and entry guidance.

  • We are not the sponsor, organizer, or operator of any Giveaway. We are not affiliated with, endorsed by, or responsible for the brands, sponsors, or platforms that run them. All entries happen on the sponsor’s own website or channel, under the sponsor’s official rules.
  • We never sell entries and never charge you to enter a Giveaway. A paid VibeWin subscription pays for software features (more personalized picks, sorting, filtering) — it does not buy entries, improve your odds, or constitute consideration for any Giveaway. No purchase from us is ever necessary to enter any Giveaway we list.
  • Our scores and summaries are opinions and estimates, produced partly with automated analysis. They can be wrong, incomplete, or out of date. Always read the sponsor’s official rules before entering; the official rules always prevail over anything we display.

2. Eligibility and your account

  • You must be at least 18 years old to use the Service.
  • You must provide accurate information, keep your credentials confidential, and are responsible for activity under your account. One account per person.
  • You are responsible for determining your own eligibility for any Giveaway (age, residence, and any other condition in the sponsor’s rules).

3. Plans, billing, and cancellation

  • The free plan is free forever. Premium is a paid subscription billed monthly or yearly through our payment provider, Stripe. Prices are shown in US dollars; the final amount, including any applicable taxes, is shown at checkout before you pay.
  • Auto-renewal: subscriptions renew automatically at the end of each period until cancelled. You can cancel anytime from your account (“Manage billing”); cancellation takes effect at the end of the period already paid, and you keep Premium until then. We do not refund partial periods except where the law requires it.
  • We may change prices with at least 30 days’ notice; changes apply from your next renewal. If you don’t agree, cancel before the renewal.
  • If a payment fails we may downgrade your account to the free plan.

4. EU/EEA right of withdrawal

If you are a consumer in the EU/EEA, you have the right to withdraw from a Premium subscription within 14 days of purchase without giving a reason. To exercise it, email hello@vibewin.app (or use the billing portal) within that period. As the subscription starts immediately, if you used the Service during those 14 days we may deduct an amount proportionate to the service already provided, as permitted by Directive 2011/83/EU, and refund the rest.

5. Acceptable use

You agree not to:

  • access the Service by automated means (scraping, crawling, bots, scripts) or extract, harvest, or republish our data, scores, or summaries in bulk, except for ordinary search-engine indexing of public pages;
  • circumvent or probe our security or rate-limiting measures, share accounts, or resell access to the Service;
  • use the Service for anything unlawful, fraudulent, or harmful;
  • reverse-engineer non-public parts of the Service except where the law gives you that right.

We may rate-limit, suspend, or block (including by IP) any access that violates this section, and may suspend or terminate accounts involved.

6. Third-party content and links

The Service links to third-party websites and reproduces limited information from public Giveaway announcements for information purposes. We do not control those sites and are not responsible for their content, rules, prizes, or conduct. Any dispute about a Giveaway (eligibility, winner selection, prize delivery, etc.) is between you and its sponsor.

7. Intellectual property

The Service — including our software, design, scoring methodology, and original content — belongs to us or our licensors. We grant you a personal, non-exclusive, non-transferable licence to use it as intended through the interfaces we provide. Third-party trademarks and Giveaway content belong to their owners. If you send us feedback, we may use it without obligation.

8. Disclaimers and liability

The Service is provided “as is” and “as available”. We do our best to keep information accurate and the Service running, but we do not guarantee accuracy, completeness, availability, or that you will win anything.

To the extent permitted by law, our total liability for any claims arising out of the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim (or €50 if you paid nothing). We are not liable for indirect or consequential damages, lost prizes, or the acts of Giveaway sponsors.

Nothing in these Terms limits liability that cannot be limited by law (including liability for fraud, wilful misconduct, or gross negligence) or affects the statutory rights you have as a consumer under EU, Spanish, or other applicable mandatory law.

9. Termination

You can delete your account at any time from the account page. We may suspend or terminate access that breaches these Terms or harms the Service, with notice where practicable. Sections that by nature should survive (IP, disclaimers, liability, disputes) survive termination.

10. Changes to these Terms

We may update these Terms. For material changes we will give reasonable advance notice (e.g. by email or an in-app notice). Continuing to use the Service after a change takes effect means you accept it; if you don’t, stop using the Service and cancel any subscription.

11. Governing law and disputes

These Terms are governed by Spanish law. If you are a consumer, you also benefit from any mandatory protections of the law of your country of residence, and you may bring disputes before the courts of your own domicile. Consumers in Spain may also resort to the consumer arbitration system (Juntas Arbitrales de Consumo) or their regional consumer office. For anyone else, the courts of Spain have exclusive jurisdiction.
